Handling Domestic Violence Cases
CRIMINAL

This CLE will teach generally how to defend against Domestic Violence allegations, with emphasis on Boulder County procedures. We will discuss different scenarios, such as a) whether the defendant confessed, b) whether there are visible injuries to the victim and c) whether the victim has a motive to fabricate, such as a pending child custody dispute for example. We will also discuss voir dire in these types of cases. Finally, we will spend time discussing the common issue of the recanting victim and how that should affect preparation. This recanting victim issue raises ethical concerns, so a brief ethics discussion will be involved. $25 CLE, $15 New/Young Lawyer, Brown Bag Lunch

The Due, the Undue and the Ugly: Influence Issues from Questioned Conduct to Proximate Cause. By their nature, claims of undue influence tend to challenge the skills of the most experienced probate practitioner. In addition to raising questions regarding the state of the law, allegations of undue influence are necessarily fact-intensive. The discussion will include construction of pertinent jury instructions, the burden of proof in disputes over testator or donor intent, applicable evidentiary presumptions and the myriad factual scenarios that may fall into the spectrum of the undue-influence controversy. This presentation will provide an overview of the different kinds of trusts and how to recognize them as well as an in depth analysis of the current law with respect to the ability of a creditor, especially a divorcing spouse, to reach the assets of the trust.
