Natural Resources CLE: An Engineering Perspective on Recent Water Court Orders and Supreme Court Rulings

The purpose of this presentation is to discuss several recent Water Court Orders in Divisions 1 and 2 and a Supreme Court Ruling that have had water rights engineering implications and how we, as engineers and attorneys, might approach future cases within this new context.  It is particularly important to understand the original case and the specific facts behind the matters at issue in order to decide whether or not these rulings should influence or guide our engineering analyses for pending and future cases.  We will discuss varying interpretations and potential applications of the orders and opinions in the water law practice area.  The Division 1 Water Court cases that will be discussed include Case Nos. 15CW3178, 06CW40 (with Supreme Court Decision in 14SA179), 11CW151, as well as Division 2 Case No. 15CW3068.
