The number of babies conceived in the U.S. with some form of assisted reproductive technology (“ART”) is growing rapidly, accounting for over 2% of all live births. ART is a broad field, and includes artificial insemination, in vitro fertilization (“IVF”), use of donor sperm, eggs or embryos, gamete and embryo freezing for pre-implantation genetic testing and fertility preservation, and gestational surrogacy. These practices are relatively lightly regulated in the U.S., especially compared with other developed countries, and various aspects of ART are currently covered by a patchwork of federal and state statutes, regulations and case law
This CLE program will introduce participants to three legal issues that arise from the provision of ART services: disposition of frozen embryos created in IVF cycles, claims for mishandling or destruction of extra-uterine embryos and other banked reproductive tissues, and the interests of donor-conceived individuals in information about their biological progenitors. The presentation will include a discussion of how the Colorado legislature and state Supreme Court have weighed in to some degree on all three.
