Every attorney owes the aspirational duty of 50 hours of pro bono work per year. However, very few attorneys meet this duty. At the same time, our communities in Colorado (and across the nation) are experiencing a justice gap where fewer and fewer litigants can afford attorneys and struggle to effectively represent themselves in court. This presentation dives into the ethical rules (CRPC 6.1-6.5) and the reasoning behind those rules. It examines the impact of the justice gap on the most vulnerable litigants (low-income, people with disabilities, older adults, and marginalized communities) and how pro bono can provide access to justice. We will explore both the intrinsic and extrinsic incentives to do pro bono work, as well as, several tools (including those encapsulated in CRCP 250.9, CRCP 204.6, and CRCP 11(b)/311(b)) to make pro bono work easier in which to engage. Finally, we will end with specific ways to engage in pro bono work in the Boulder community!
