As renewable energy development continues to expand across rural Colorado, attorneys are increasingly called upon to represent landowners in complex, long-term transactions with solar, wind, and energy storage developers. This presentation provides practitioners with a practical framework for negotiating these agreements, informed by the presenter’s experience negotiating such transactions on behalf of renewable energy developers. The session will begin with a high-level overview of the renewable energy development lifecycle from site identification through commercial operation, informed by the technological constraints and economic models that drive project design and developer decision-making. The presenter will then explore the key negotiated terms in option agreements and leases—including option payments, per-acre lease rates, annual escalation, crop damage provisions, decommissioning obligations, and mineral rights issues—with insight into which terms developers treat as negotiable and which are driven by project financing requirements. The presentation will also address related topics like easements, assignment, project financing structures, and lender protections that shape the long-term relationship between landowners and project owners. Attendees will leave with actionable strategies for protecting landowner clients while facilitating mutually beneficial renewable energy transactions
