Fiduciary Compensation
ELDER

Please join the Elder Section for their April CLE. Fiduciary Compensation - What is appropriate fiduciary compensation for a lay person or professional acting as a fiduciary for a probate administration, conservatorship, or guardian? Some questions which may be discussed in this CLE are: Is there a generally acceptable range for lay fiduciary fees? How do the complexity of the estate issues factor in to the reasonableness of the fees? Should a tiered billing strategy be used for complex and manual labor tasks, or should a lower flat rate be used? How detailed should a billing statement be for a professional fiduciary? How detailed should a billing statement be for a lay fiduciary? Is there a lay fiduciary rate ceiling that is per se unreasonable? Should a non-institutional fiduciary use a percentage basis to charge fees in light of the recent changes in the Cost Recovery and Compensation Act? The judges may use case scenarios to examine the questions above.
